Terms of Service
1. These terms
These terms are an agreement between you and Programmable, LLC, 3607 10th St NW, Washington, DC 20010, USA (“we”, “us”) for the use of programmable.page, its app, API, MCP server and text, call and email channels (the “Service”). You accept them, together with the Data Processing Addendum (“DPA”), which forms part of them, when you create an account or use a workspace. If you accept them for a business, you confirm you may bind it, and “you” means that business. You must be at least 18. Section 14 covers people who only receive or use a page.
2. The Service
The Service makes web pages from what you ask for (by text, call, email, the app, a link or your own tools) or from ready-made templates, and lets you send them to your customers: invoices, quotes, bookings, forms, menus, live boards and more. Pages can collect replies, bookings, signatures and files, take payments through your own Stripe account, and run jobs such as making a PDF.
3. Accounts and workspaces
- You sign in with a code we email you or through the shared Programmable sign-in. Keep your sign-in, API keys, text keys and link keys secure; you are responsible for what is done with them, and by the team members and contacts you add.
- Tell us promptly at [email protected] if you think your account or a key has been misused.
- Give accurate information, and keep your email address current: we send notices about the Service and these terms there.
4. Your content and your customers' data
- You keep all rights in what you put into the Service (requests, page content, brand, files) and in your customers' data. You give us a licence to host, copy, process, display and transmit it only as needed to run the Service for you, including showing pages to anyone with their link, and public pages to anyone.
- You confirm you have the rights to what you publish, and that it doesn't infringe anyone's rights or break the law.
- You can export your workspace's data at any time, and delete pages, replies, customers or the whole workspace.
5. Data protection
For your customers' personal data you are the controller and we are your processor, on the terms of the DPA. In particular you agree to:
- Have a lawful basis for the personal data you put on pages or collect through them, and give your customers any notice the law requires.
- Email and text only people who have agreed to hear from you, in line with the laws that apply to you (for example the TCPA, CAN-SPAM, CASL, PECR and the GDPR). Before texting a customer, you confirm they agreed to get texts from you; the Service records that confirmation. Opt-outs (STOP) are honoured automatically, and you must not try to get around them.
- Not collect, through pages or otherwise, special categories of personal data (health, religion, sexual orientation and the like) unless the law allows it and you are responsible for it, nor government ID numbers, payment card details or passwords. Pages that ask for passwords may be held for review and not shown.
6. Acceptable use
You may not use the Service to:
- Make phishing pages, or pages that impersonate another business, person, brand or authority, or that try to collect sign-in details, card numbers or other secrets.
- Send spam or deceptive messages, or text or email people who haven't agreed to hear from you.
- Publish unlawful, infringing, harassing, hateful or sexually explicit material, or scams, or content that promotes violence.
- Sell or take payment for anything illegal, or for anything Stripe's terms prohibit.
- Probe, scan or test the Service's security without our written permission; interfere with its working; get around its sandbox, limits or review; or scrape it.
- Resell the Service or use it to build a competing product, except as these terms or a separate agreement allow.
New pages are checked automatically. A page that looks like it collects passwords or sends people elsewhere may be held for review before anyone can see it, and anyone can report a page. We may take down a page, or suspend a workspace, that breaks these rules.
7. Payments to you
Pay buttons on your pages take payments through your own Stripe account, using a key you give us. The sale is between you and your customer: you set the price, deliver what was paid for, handle refunds, disputes and taxes, and comply with Stripe's terms. We are not a party to it, never hold the money, and never see card details. Refunds and recurring payments you start in the Service are made in your Stripe account.
8. Services you connect
You can connect outside services: Stripe, your own storage (an S3-compatible bucket), your webhooks, and your own tools through the API or MCP. They run on your accounts, at your cost, under their own terms. When you connect one, you tell us to send it the data it needs. We aren't responsible for those services, and we may stop supporting one if its provider changes or ends its interface.
9. AI-written pages
Pages, the details read out of your requests, and suggested text are written by AI models (Anthropic's Claude) and can be wrong: an amount, a date, a name. Check every page before you send it or rely on it; you are responsible for what you send. Templates fill in exactly the details you give.
10. Plans and fees
The Free plan costs nothing and has daily limits. The Pro plan (currently $29 / month) raises them and is billed in advance through Stripe for each period, renewing automatically until cancelled. You can cancel at any time from Settings → Plan (Manage billing); Pro then runs to the end of the period you paid for. Prices exclude taxes, which you pay where they apply. Except where the law requires otherwise, fees already paid are not refunded. We will give you at least 30 days' notice of a price change, which takes effect at your next renewal.
Limits (pages, publishes and texts) are shown in the app and may change; we will tell you before reducing a limit on a paid plan. Services you connect may charge you themselves.
Finishing a Getting started tour can add bonus page generations to your workspace. They are included, used only once your daily limit is reached, and don't lapse while the workspace is open. Each is given once per workspace owner, stays with the workspace it was given to, and can't be transferred, sold or exchanged for money or credit. They end when the workspace is closed, and we may withdraw ones obtained by abuse of the Service.
11. Changes to the Service and to these terms
We improve the Service continually, and may add, change or remove features. If a change materially reduces what you rely on, we will tell you ahead of time where we reasonably can. We may update these terms; for material changes we will tell you by email or in the app at least 14 days before they take effect. Changes don't apply to anything that happened before them.
12. Suspension and ending
- You can stop using the Service at any time and close your workspace or account in Settings, or ask us at [email protected]. Closing a workspace deletes it, its pages and their data at once, and ends any paid plan.
- We may suspend or end your access, or take down a page, if you breach these terms materially or repeatedly, if your use puts others or the Service at risk, or if the law requires it. Where it is reasonable and lawful, we will tell you first and give you a chance to fix the problem.
- We may end the Service as a whole with at least 60 days' notice, so you can export your data.
- Sections 4 (the licence, until deletion), 7, 9, 13, 15, 16, 17 and 18 survive.
13. Our property
The Service, its software, templates and design belong to us and our licensors; these terms don't transfer them to you. Pages made for you are yours to use. If you send us feedback, we may use it without owing you anything.
14. If you receive or use a page
You don't need an account. A page comes from the business named on it, which is responsible for it and for what you buy, book or agree to there. Payments go to that business through Stripe. How your data is handled is in the Privacy Policy. If a page looks like a scam, report it from the page or write to [email protected]. Sections 6, 13, 15, 16 and 18 apply to you too, so far as the law allows.
15. Disclaimers
We work to keep the Service available and correct, but it is provided “as is” and “as available”. So far as the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and that the Service will be uninterrupted or error-free, or that texts and emails will be delivered. Nothing in these terms limits rights that consumer law gives you and that can't be waived.
16. Limits on liability
So far as the law allows: neither side is liable to the other for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, goodwill or data; and each side's total liability arising out of these terms or the Service is limited to the greater of the fees you paid us in the 12 months before the claim and US$100. These limits don't apply to your obligations under section 17, to amounts you owe us, or to liability the law doesn't allow to be limited (such as for fraud, or for death or personal injury caused by negligence).
17. Your responsibility to us
You will defend and indemnify us against third-party claims, and the resulting losses and reasonable costs, arising from your content and pages, what you sell through them, the messages you send and the people you send them to, how you use your customers' data, or your breach of these terms or of the law. We will tell you promptly about such a claim, let you control its defence, and cooperate reasonably at your cost; you won't settle it in a way that admits fault on our part without our consent.
18. General
- These terms are governed by the laws of the District of Columbia, USA, without regard to its conflict-of-laws rules, and disputes go to the courts of the District of Columbia, USA, except that either side may seek urgent relief in any competent court. If you are a consumer, you keep the protection of the mandatory law where you live, and can also bring a claim there.
- These terms, the DPA and any order form are the whole agreement between us about the Service. If one part can't be enforced, the rest still applies. Not enforcing a part isn't a waiver of it.
- You may not transfer these terms without our consent. We may transfer them to a successor of our business, and will tell you if we do.
- Neither side is liable for delays or failures caused by events beyond its reasonable control.
- Notices to us go to [email protected]. Notices to you go to your account's email address.
- Text messages: Mobile information (phone numbers and text-message consent) is not shared with third parties or affiliates for marketing or promotional purposes. See the Privacy Policy for STOP and HELP.
